1. Heard learned counsel for the appellants and the State.

2. At the outset, it is submitted on behalf of the State that the appeal, seeking pre-arrest bail to the appellants, is not maintainable as cognizance has already been taken by the Court

Patna High Court CR. APP (SJ) No.1687 of 2023(2) dt.02-08-2023 2/2 below also for the offences punishable under the SC/ST Act. In this regard, reliance is placed in the case of Bachu Das Vs. State of Bihar and others, reported in (2014) 3 Supreme Court Cases 471.

3. However, learned counsel for the appellants seeks permission to withdraw this appeal.

4. Accordingly, present appeal is dismissed as withdrawn.
