20-06-2022 Heard learned counsel for the parties.
The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
It is submitted on behalf of petitioner that specific allegation of firing is against co-accused Vikash Kumar. So far as this petitioner is concerned, there is general and omnibus allegation. No case under Section 307 of the Indian Penal Code is made out against this petitioner. It is further submitted that other four similarly situated co-accused have already been extended the privilege of anticipatory bail by a coordinate Bench of this Court, vide order dated 14.12.2021 passed in Cr.Misc. No. 20742 of 2021. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the prayer for bail.

No.31249 of 2021(4) dt.20-06-2022 2/2 Considering the nature of accusation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Mahua P.S. Case No. 496 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
