JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 The petitioner seeks regular bail in connection with Saharsa Sadar P.S. Case No. 921 of 2017, registered for offences punishable under Section 392 of the Indian Penal Code. Allegation as per F.I.R. is that three miscreants on the point of pistol snatched the bag of informant containing Rs. 1,36,783/-.

It has been submitted on behalf of the petitioner that he is not named in the F.I.R. later on his name transpired on the information supplied by the spy. However, nothing has been recovered from the possession of the petitioner and he has not been put on Test Identification Parade and although he is accused in eight other cases but in all those cases, he is on bail and in this case, he has been in judicial custody since

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar P.S. Case No. 921 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
