JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 26-04-2019 The petitioner is aggrieved by the appointment of private respondent No. 9 on the post of Anganbari Sevika in Ward No. 1, Sareya Srikant Panchayat, Block-Basantpur, in the District of Siwan.

2. It has been submitted on behalf of the

Patna High Court CWJC No.6816 of 2019 dt.26-04-2019 2/3 petitioner that she was adjudged the most suitable candidate in the first Aam Sabha which was held for finalizing the list of such aspirants but later, by taking resort to a different mapping register, another Aam Sabha was summoned and private respondent No. 9 was chosen to be engaged as Anganbari Sevika, bypassing the rightful claim of the petitioner.

3. A complaint in that regard has been preferred before the District Programme Officer, Siwan but the same has not yet been acted upon.

4. The aforesaid information has been provided to this Court on the basis of no notice having been received by the petitioner for any hearing in the matter.

5. Under the aforesaid circumstances, this Court directs the petitioner to make a fresh complaint/ representation before the District Programme Officer, Siwan (respondent No. 5), detailing her grievances, within a period of two weeks from today, who, on receipt of such complaint/representation shall verify the facts and after affording hearing all the concerned stakeholders/necessary

6. If the petitioner still remains dissatisfied with the order passed by the District Programme Officer, Siwan, she would have the liberty to file an appeal before the District Magistrate, Siwan.

7. With the aforesaid observation/direction, the writ petition stands disposed off.
