JUSTICE RAKESH KUMAR ORAL ORDER 22-12-2016 Heard Sri Kumar Vishoka Nand, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Complaint Case No. 78(7) of 2016, corresponding to Special Case No. 17 of 2016, for offence under Section 20(a) of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on an allegation that petitioner has planted 4 plants of Ganja has been taken into custody and she is in custody since 24-08-2016. By way of referring to statement made in paragraph - 3 of the petition, it has been argued that petitioner is having clean antecedent.

Considering the fact that petitioner is a lady, clean

No.49598 of 2016 (3) dt.22-12-2016 2/2 antecedent as well as period of custody, let the petitioner namely Manjhali Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Madhepura in connection with Complaint Case No. C-78(7) of 2016 under Bihariganj Special Case No. 17 of 2016.
