The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.
Allegation is that on 20.07.2018 in the evening the informant parked his motorcycle in front of V2 shop and went to purchase clothes. When he returned back, he found that his motorcycle was missing from there.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.1.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. There is no recovery of any incriminating
Patna High Court CR. MISC. No.21369 of 2019(4) dt.13-05-2019 2/2 article from the possession of the petitioner. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. case No.651 of 2018.
