2. The petitioners are apprehending their arrest in connection with Jamui P.S. Case No. 694 of 2022 for the offence under Sections 419, 420, 467, 468, 120(B) and 471 of the Indian Penal Code, lodged on 15.12.2022 by the informant, Dhruv Kumar.

3. As per the prosecution story, the Police upon information that the accused involved in cyber crime Chhotu Kumar is currently at home. It was raided, two persons jumped from the roof of the house but got injured, they were Chhotu Kumar and Amarjit Kumar from there is recovery/seizure of

2/4 five mobile phones beside the ten SIM Cards and several passbooks/cheque books/ATM Cards. This led to the F.I.R.

4. Learned counsel for the petitioner submits that they have nothing to do with the said crime, have no criminal antecedent, only because the two accused them, they are involve in it. He however concede that they have delayed coming to the Court as had no knowledge about the confession made by the accused persons. The last submission is that they shall be diligently appearing in trial and undertake not to indulge in any other criminal case failing which the State/court shall take immediate steps for canceling the bail bond, if relief is granted in the case.

5. Learned APP Mr. Jitendra Kumar Singh opposes the prayer for bail submitting that the two accused who were caught alongwith incriminating documents have named him.

Having heard the parties, though the name is there, the fact remains that they do not have criminal antecedent and an undertaking has been given that they shall be diligently appearing in trial and not to commit any other offence failing which the State/Court shall take immediate steps for cancellation of their bail bond, in that background, this Court is inclined to extend them the privilege of

3/4 anticipatory bail.

Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No. 694 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C., as also with the following conditions:- (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioners shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the Trial Court itself; (iii) the petitioners shall appear before the concerned police station every fortnight for next six months to mark their attendance;

(iv) the petitioners shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for

4/4 cancellation of the bail bonds;

(v) the petitioners shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds. (Rajiv Roy, J) vinayak/- U T
