JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 19-07-2024 This application has been filed for modification of order dated 05.09.2023 as well as for extension of time for surrender of the petitioner in the court below.

2. Learned counsel for the petitioner submits that the petitioner was earlier granted anticipatory bail by this Court vide order dated 05.09.2023 passed in Cr.Misc.No.31125 of 2022 but due to the reasons that pairvikar of the petitioner became ill and did not inform him about granting bail, the petitioner could not surrender before the court below within the stipulated time. Learned counsel for the petitioner submits that he has complied the order dated 10.05.2024.

3. In view of the submissions of learned counsel for the petitioner as well as the averments made in the petition, the

Patna High Court CR. MISC. No.27850 of 2024(4) dt.19-07-2024 2/2 modification petition is allowed. The period for surrender of the petitioner before the court below is extended by six weeks from today.

4. Accordingly, the order dated 05.09.2023 passed in Cr.Misc.No.31125 of 2022 is modified to the extent as indicated above.
