The petitioner seeks bail in a case instituted under Sections 457 and 380 of the Indian Penal Code. The prosecution story in brief, is that some unknown thief taking advantage of the opened house, committed theft of inverter battery, feeder and wrist watch of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.09.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The petitioner is not named

On behalf of the state, it has been submitted that the name of the petitioner has come in course of investigation.
