2. The petitioner has prayed for bail in connection with Bakharpur P.S. Case No.68 of 2025 registered for the offence punishable under Sections 191(2), 191(3), 190, 115(2), 118(1), 103(1), 117(2), 109, 352, 351(2) of the BNS and under Section 27 of the Arms Act.
3. The case of the prosecution, in short, is that altogether 30 persons have assaulted the husband of the informant with various weapons like rifle, gun, hasua, iron rod and lathi. The husband of the informant succumbed to the injuries.
4. Learned counsel appearing on behalf of the petitioner has submitted that in this case there are altogether 28 named accused persons. The nature of allegation is general and omnibus. Learned counsel for the petitioner has further submitted that from
Patna High Court CR. MISC. No.21122 of 2026(2) dt.02-04-2026 2/2 perusal of the order of the learned trial court it will transpire that the deceased has received altogether 10 injuries whereas allegation is against 30 persons of assaulting the deceased. Learned counsel for the petitioner has further submitted that the petitioner is only member of the mob and no over act is alleged against him. Learned counsel for the petitioner has further submitted that the petitioner is having no criminal antecedent and he is in judicial custody since 04.09.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the court of learned Judicial Magistrate- 1st Class, Bhagalpur in connection with Bakharpur P.S. Case No.68 of 2025.
