Petitioner seeks bail in Bairiya P.S. Case No. 258/18 registered for the offence under Sections 341, 342, 323, 504/34 of I.P.C. and Section 8, 12 of POCSO Act.

Allegation is of keeping the girl in Orchestra party. Submission on behalf of the learned counsel for the petitioner is that though the allegation is false and concocted, there is recovery of girls, but neither the said girls were examined by the police nor their medical examination was held by the police. The petitioner is in custody since 17.07.2018 having no criminal antecedent. The charge sheet has been submitted. Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.64856 of 2018 (2) dt.02-11-2018 2/2 circumstances of the case, stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Additional Distriart and Sessions Judge-1-cum Special Judge, Bettiah,Westchamparan, in Bairiya P.S.Case No.258 of 2018 with condition that bailors must be of local having sufficient immoveable properties within jurisdiction of the court concerned.
