Petitioner is accused in connection with Jhanjharpur (Arariya Sangram O.P) P.S. Case No. 218 of 2014 registered under Sections 392 of the I.P.C.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. His name has come only on confessional statement of co-accused. Neither the alleged motorcycle has been recovered from the possession of the petitioner nor has he been put on Test Identification Parade. Also the petitioner is in custody since 29.07.2016.

Having considered the facts and circumstances of the
