JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is the husband of the informant and seeks anticipatory bail in a case registered for the offences punishable under Section 498A of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the prosecution story as narrated in the First Information Report is completely false and malicious. He has further submitted that the informant's father was a Rickshaw puller and the allegation of demand of dowry to the tune of Rs. 2,00,000/- and payment of Rs. 1,80,000/- as dowry is absolutely imaginary and baseless. He has drawn my attention to Annexure-2 of this application in order to contend that the informant was earlier married to one Lal Babu
Patna High Court Cr.Misc. No.48193 of 2014 (2) dt.23-04-2015 Sao against whom also she had made similar allegation as made in the present case and she is in habit of instituting the false case. From the First Information Report and the submission made on behalf of the petitioner, it appears that the institution of the police case against the petitioner is a result of matrimonial discord between the petitioner and the informant. In view of the submission made above, let petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Kahalgoan ( Ghogha) P.S. Case No. 312 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
