The petitioner seeks bail in Biraul P.S. Case No. 55/2016, registered for the offences punishable under Sections 498(A), 313, 341, 323, 342 and 34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.
The petitioner is the husband of the informant. The informant alleged that she was married to the petitioner in the year 2009 and she gave birth to a male child. Thereafter the petitioner deserted her and also forcibly terminated her pregnancy due to non-fulfillment of demand of dowry.
Learned counsel for the petitioner submits that the petitioner is in jail since 14.09.2016.

Patna High Court Cr.Misc. No.29 of 2017 (2) dt.02-03-2017 2/2 the informant opposed the prayer for bail and submitted that the informant is ready to live with her husband as she has got no source of income.
Considering the nature of allegations made against the petitioner and the fact that the petitioner is ready to keep his wife and the petitioner has already remained in jail for about six months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Biraul, Darbhanga in connection with Biraul P.S.
