====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-06-2020 Heard Mr. Jharkhandi Upadhyay, learned counsel for the petitioner and Mr. Suresh Prasad Singh, learned APP for the State.
The petitioner seeks bail in connection with Guraru P.S. Case No. 147 of 2019, dated 03.12.2019, instituted for the offences under Sections 406, 420, 467, 468, 504 and 506 of the Indian Penal Code.
The informant of this case is the Ward
Patna High Court CR. MISC. No.18833 of 2020(2) dt.09-06-2020 2/3 Councillor, who has alleged that the work of Nal-Jal scheme was entrusted to the petitioner and on various dates, a total amount of Rs. 20,00,000/- was paid to him. However, the work was never completed. The petitioner is also alleged to have dilly-dallied in returning the amount which has not been spent on the work.
Learned counsel for the petitioner has submitted that the allegation is absolutely false in as much as whatever work was entrusted to the petitioner, he has completed the same. The work under the scheme referred to above was also given to two other persons, who, even today, have not completed their part of the work for which the petitioner cannot be held responsible.
The petitioner is stated to be in custody since 23.12.2019.
Regard being had to the facts aforestated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
