The petitioner is in custody since 25.07.2016 in connection with Daudnagar P.S. Case No.124 of 2016 registered for the offences under Sections 147, 148, 149, 384 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. Learned counsel for the petitioner submits that the alleged cartridges were not recovered from the conscious possession of the petitioner. It is further submitted that on the instigation of one Somaru Yadav, the petitioner has been arrested while he was sitting at Shiv Mandir.
