The petitioner apprehends his arrest in Fulwaria P.S. Case No.258 of 2018 registered under Sections 366, 379 and 34 of the Indian Penal Code.
The informant alleged that Suraj Kumar kidnapped his daughter-in-law with the help of Subhash Mali(the petitioner). The daughter-in-law took away ornaments worth of Rs.2,50,000/- with her.
The learned counsel for the petitioner submits that victim was recovered. Suraj Kumar has already been granted regular bail. The victim is major and she did not make any sorts of allegation against the petitioner.
Taking into consideration the facts aforesaid and the fact that Suraj Kumar who is alleged to have kidnapped the
Patna High Court CR. MISC. No.21035 of 2019(2) dt.04-04-2019 2/2 victim has already been granted bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. XIII, Gopalganj in connection with Fulwaria P.S. Case No.258 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
