Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 498(A), 323 of the Indian Penal Code.
As per the prosecution case, petitioner along with other family members committed torture on the informant's sister due to non-fulfilment of dowry demand. Petitioner no. 1 is father-in-law and the petitioner no.2 is the second wife of husband of the informant. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.21551 of 2023(2) dt.19-05-2023 2/2 petitioners are innocent and have falsely been implicated in this case. It is further submitted that the petitioners are separate in mess and business. Thrust of allegation is against the husband of the informant's sister.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Bikramganj, Rohtas in connection with Complaint Case No. 147 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
