The petitioner is in custody since 31.08.2018 in connection with Dharhara P.S. Case No. 231 of 2018 for the offence registered under Sections 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though he is not named in the first information report, the victim girl in her statement under Section 164 Cr.P.C. has named the coaccused, namely Govinda Mandal but not named the present petitioner.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing

Patna High Court Cr.Misc. No.78394 of 2018(2) dt.28-01-2019 2/2 bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J.-1st-cum-Spl. Judge, POCSO, Munger in connection with Dharhara P.S. Case No. 231 of 2018.
