2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 25 (1B)) a, 26 and 35 of the Arms Act.
3. The case of the prosecution, in brief, is that from the possession of petitioner no. 1, one country-made pistol, and from the possession of petitioner no. 2, one live cartridge, were recovered.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted that

It is further submitted that the witnesses to the seizure list are police personnel and that the provisions of Section 105 of the B.N.S.S. have not been complied with while making the seizure. It has also been submitted that petitioner no. 1 has criminal antecedents of three cases, while petitioner no. 2 has criminal antecedents of one case.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Pipra P.S. Case No. 408 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul.
