Case No.502 of 2012 registered for the offences punishable under Section 409, 420, 468, 471, 120B and 34 of the Indian Penal Code. Apprehending his arrest, the petitioner filed ABP No.182 of 2013 before the Sessions Judge, Saharsa. The same was rejected on 27.05.2013. Hence, this application for grant of anticipatory bail under Section 438 Cr. P.C.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This Court called for a report at some stage. From perusal of the same it becomes clear that except that the petitioner worked as an employee in the post office, he did not figure anywhere in the context of withdrawing a sum of Rs.50,000/- from the account of third person.

Therefore, the application is allowed. It is directed that in the event of arrest, the petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa (Sadar) P. S. Case No.502 of 2012. It is further directed that the petitioner will cooperate with the police during investigation for further steps. (L. Narasimha Reddy, CJ) Sunil/- U T
