JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with allegation that he as well as three other F.I.R named accused mercilessly assaulted the informant and his two sons. However, after 8 days of the alleged occurrence, the informant died in course of his treatment and in post mortem report, the doctor opined that the informant died due to Septicemia leading to Cardiac Respiratory failure as a result of infection in the wound of the deceased. The alleged occurrence took place in the year 2011 but petitioner could be remanded in this case on 06.06.2016 i.e., after five years of the alleged occurrence. However, it is submitted on behalf of the petitioner that having more or less similar allegation,
Patna High Court Cr.Misc. No.40850 of 2016 (3) dt.23-11-2016 2/2 almost all the co-accused have already been granted privilege of bail by a co-ordinate Bench of this Court. It is further submitted that petitioner had gone out side the State to earn his livelihood and when he returned to his home, without any delay, he surrendered in the court below.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S.Case No. 130 of 2011.
