JUSTICE SANJAY PRIYA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Haspura P.S. Case No. 206 of 2016 instituted for the offence under sections 457 and 380 of the Indian Penal Code.

It has been alleged that theft has been committed in the house of the informant and mobile phone and cash amounting to Rs. 2000/- have been stolen.

FIR has been registered against unknown.

From the impugned order, it appears that one coaccused Avinash @ Munna was apprehended and his confessional statement was recorded in para 21 of case diary. He has disclosed the name of this petitioner.

From the impugned order, it appears that except

Patna High Court Cr.Misc. No.12189 of 2017 (2) dt.22-03-2017 2/2 disclosing the name of this petitioner in the confessional statement of co-accused there is no any substantive material against this petitioner.

It is mentioned in para-3 that the petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner(s) is allowed. In the event of surrender/arrest of the petitioner(s) named above, within six weeks from today, in connection with Haspura P.S. Case No. 206 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S. Pandey, Judicial Magistrate 1st Class, Daudnagar, Aurangabad, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Sanjay Priya, J) Ravi/- U T
