Petitioner seeks bail in Banka P.S. Case No.621 of 2015 instituted for the offence under Section(s) 302, 201/34 Indian Penal Code.
Counsel for the petitioner submits petitioner is not named in the First Information Report. Mere suspicion has been raised against the petitioner. It is further submitted that one Hira Yadav was having love affairs with Shabnam Kuamri, wife of the deceased. Aforesaid Hira Yadav has disclosed the name of this petitioner in his confessional statement.
It has been submitted that co-accused, Hira Yadav, has been granted bail by co-ordinate Bench of this Court by order dated 11.05.2016 passed in Cr. Misc. No.7683 of 2016.
Patna High Court Cr.Misc. No.65674 of 2018 (2) dt.06-11-2018 2/2 Petitioner is in custody since 04.09.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No.621 of 2015, subject to the condition that both the bailors shall be close relative of the petitioner.
