Petitioner apprehend his arrest in Jhajha P.S. Case No.22 of 2019, registered under Sections 272, 273, 419, 420 and 34 of the Indian Penal Code as well as under Sections 30(a) and 38(1) of the Bihar Prohibition and Excise Act. The informant, on secret inputs, intercepted a pickup van bearing Registration No.WB 37D 2540 loaded with bundle of mats and apprehended the driver and co-driver, Chhotu Mahto and the cleaner of the vehicle. Chhotu Mahto disclosed in his confessional statement that Govind Ram and Amar Sharma hired the vehicle for transportation of bundle of mats but they kept 86 litres Indian made foreign liquor in the bundle of mats but petitioner being the owner of the vehicle has also

Learned counsel for the petitioner submits that the driver was plying the vehicle on hire. Petitioner had no knowledge that Amar Sharma and Govind Ram in stead of transporting mats kept liquor in the bundle of mats. Taking into consideration the facts and nature of allegations made against the petitioner and the fact that there is no material to show that the petitioner had any knowledge that Amar Sharma and Govind Ram were carrying liquor in the pickup van in the bundles of mats, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-2nd, Jamui in connection with Jhajha P.S. Case No.22 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
