No.2809 of 2012) in which cognizance has been taken for the offence punishable under Section 498A of the Indian Penal Code. Apprehending his arrest, the petitioner filed BP No.110A of 2013 before the Sessions Judge, Kaimur at Bhabua. The same was rejected on 01.06.2013. Hence, this application for grant of anticipatory bail under Section 438 Cr. P.C.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The only allegation against the petitioner is one

Patna High Court Cr.Misc. No.31131 of 2013 (4) dt.09-04-2015 2/2 under Section 498A of the Indian Penal Code. In a case of this nature, it is not at all necessary that the accused must be arrested.

Therefore, the application is allowed. It is directed that in the event of arrest, the petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Magistrate, Kaimur at Bhabhua in connection with Complaint Case No.147 of 2012 (Tr. No.2809 of 2012).
