In the present case, the petitioners are seeking bail in Bachhwara P.S. Case No. 28 of 2020 registered for the offence punishable under Sections 188, 272, 273 of the Indian Penal Code and Section 30 (a) and 30 (d) of Bihar prohibition and Excise Act, 2016.

On the secret information received by the police, a raid was conducted and about 20 liters of illegal liquor along with several instruments for manufacturing of wine has been recovered and they were arrested from the spot itself, however, counsel for the petitioners submits that they are in judicial custody since

Patna High Court CR. MISC. No.19183 of 2020(2) dt.10-06-2020 2/2 20.02.2020. It is claimed that their antecedents are clean. Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-II-cumSpecial Judge, Excise Act, Begusarai in connection with Bachhwara P.S. Case No. 28/2020 with a condition that if the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court/prosecution would be at liberty to take steps for cancellation of their bail bonds.
