JUSTICE PARTHA SARTHY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner who is in custody since 1.3.2020 has filed the instant application for grant of regular bail in connection with Excise Complaint Case no. 18 of 2020 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the complaint, in course of checking of vehicle, two persons abandoned a car and made an attempt to escape. On being caught and on the car being searched, 69.120 litres of country liquor was found.

It is submitted by learned counsel for the petitioner that no incriminating material has been recovered either from the vehicle or possession. He has no criminal antecedent and is in custody since 1.3.2020. It is further submitted that charge sheet has been submitted in the

Patna High Court CR. MISC. No.19172 of 2020(2) dt.04-06-2020 2/2 case.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration that the petitioner has no criminal antecedent and is in custody since 1.3.2020, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Excise Complaint Case no. 18 of 2020 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Banka.
