JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-04-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sahebganj P.S. Case No. 388 of 2018 for the offenses under Sections 399, 402and 414 of the Indian Penal Code and Sections 25(1-B)a, 26/35 of the Arms Act.

Learned counsel for the petitioner submits that from the possession of the petitioner a motorcycle was seized and on demand of documents he failed to produce the same. The petitioner is in custody since 19.10.2018.

Considering the fact that pistol was recovered from the possession of other co-accused and not the petitioner and the petitioner has remained in custody for more than 5 months, let the petitioner, above named, be enlarged on bail on furnishing

Patna High Court CR. MISC. No.22649 of 2019(2) dt.09-04-2019 2/2 bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM 1st West Muzaffarpur in connection with Sahebganj P.S. Case No. 388 of 2018.
