This application has been filed in connection with Jagdishpur (Goradih) P.S.Case No.4/16 for the offence under Sections 302, 201/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the allegation against him is that a case was lodged by the informant stating that his brother, Bhadeshwar Mandal, had seen the petitioner along with other accused persons throwing the deadbody in a well and later on, the dead body of the deceased was recovered from the well. Petitioner is in custody since 12.7.2016. The other accused persons, having similar allegation, have been granted bail by this Hon'ble Court, vide order dated 20.12.2016 passed in Cr. Misc. No.47306 of 2016.
Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.54728 of 2016 (4) dt.30-01-2017 2/2 bail of the petitioner.
Having heard both sides. In view of the fact that the coaccused, having similar allegation, have been granted bail by this Hon'ble court and the petitioner is in custody for about seven months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Jagdishpur (Goradih) P.S.Case No.4 of 2016 with condition that One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court and further the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail. With the aforesaid application, this application is allowed.
