Petitioner seeks regular bail in connection with Brahampur (Krishna Brahm) P.S. Case No. 527 of 2020 corresponding to the Sessions Trial No. 26 of 2021 registered for the offence under Section 341, 326, 302, 201, 506 / 34 of the I.P.C.

The allegation as per First Information Report lodged by the son of the deceased is that the deceased had left her house for grass cutting on 29/09/2020 but when she did not return back to home, search was carried out by the informant and other family members and on 30-09-2020 the informant

Patna High Court CR. MISC. No.30450 of 2021(2) dt.07-12-2021 2/3 found the dead body of his mother lying in the field and suspicion has been raised by the informant against the petitioner and others.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and has been made accused on the basis of suspicion raised by the informant. He next submits that informant is not an eye witness and no body has seen the occurrence. He further submits that petitioner is unmarried and the deceased -Babita Devi was having love affair with the petitioner which was not to the liking of the informant and his family members due to which the informant and his family members themselves have killed the deceased -Babita Devi. Thus, submission is that this is a case of honour killing by the informant and his family members.

Learned counsel further submits that petitioner is in custody since 09-102020, charges have already been framed against the petitioner and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 09.10.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Buxar (the trial court) in connection with Sessions Trial No. 26 of 2021 arising out of Brahampur (Krishna Brahm) P.S.
