The petitioners seek bail in connection with Baligaon P.S. Case No.16 of 2021 registered for the offence under Sections 395 of the Indian Penal Code.

The allegation against the petitioners is to have taken away Rs. 1,37,000/- Lenovo tab, Samsung tab, etc. of the informant informant.

Learned counsel appearing on behalf of the petitioners has submitted that petitioners have falsely been implicated in the present case, where, petitioners is not named the FIR. It is submitted that name of the petitioners surfaced during course of investigation on the basis of other co-accused

Patna High Court CR. MISC. No.25086 of 2024(2) dt.20-05-2024 2/3 persons, namely, Ramesh Kumar Sahni and Chandan Paswan @ Vikki. It is further submitted that similarly situated other coaccused persons have already been granted bail by a learned coordinate Bench through Cr. Misc. No.60733 of 2022 on 23.01.2023, Cr. Misc. No.59826 of 2022 on 17.01.2023 and Cr. Misc. No. 30010 of 2023 on 20.02.2024. It is further submitted that the petitioners are in custody since 03.11.2022. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioners. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioners, let the petitioners, above named, is directed to be released on bail, after framing of the charge, in connection with Baligaon P.S. Case No.16 of 2021 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge III, Vaishali at Hajipur.

The trial court is directed to conclude the proceeding of framing of charge according to law within a period of 15 (fifteen) days from the date of receipt of a copy of this order. However, it is made clear that if the charge-sheet has not been submitted then the above named petitioners shall
