JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 498(A), 323, 307, 34 of the Indian Penal Code and Sections 3/ 4 of the Dowry Prohibition Act. The accusation is of torture for non-fulfillment of dowry demand and making an attempt to kill the informant by sprinkling kerosene oil.

The marriage took place on 02.06.2013 and since then the informant is living at her parent's house. Finding no way to settle the dispute, the petitioner has filed Matrimonial Case No. 129 of 2014 for dissolution of marriage and thereafter the informant has filed the present case in order to harass the petitioner. The petitioner is employed in R.P.F, Railway at Orissa while the informant is also employed and working as a teacher getting monthly salary of Rs. 35,000/-. The petitioner is languishing in custody since 15.02.2023.

Learned counsel appearing on behalf of the informant has vehemently opposed the prayer for bail of the petitioner and submitted that petitioner is husband of the informant and he does not want to keep the informant.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be

Case No. 185 of 2014.
