Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 341, 452, 504 of the Indian Penal Code and Section 3⁄4 of the Prevention of Witch Practices Act. It is alleged that accused persons entered into the house of the informant variously armed and assaulted the mother of the informant as the accused were under belief that she practices witch craft. Subsequently the mother of the informant succumbed to the injuries.
It is submitted by learned counsel for the petitioners that petitioners were not sent up for trial but differing with the final form, cognizance has been taken. It is further submitted that other co-accused have been granted
Patna High Court Cr.Misc. No.46801 of 2014 (2) dt.24-04-2015 2/2 regular bail vide Cr. Misc. Nos. 52377 of 2013 and 13171 of 2014.
In view of the above facts, let learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender and pray for regular bail in connection with Parasbigha P.S. Case No. 50 of 2013, pending in the Court of learned Chief Judicial Magistrate, Jehanabad. Accordingly the application is disposed off.
