2. The petitioner apprehends his arrest in connection with Bodhgaya P.S. Case No. 315 of 2020 instituted under Sections 379, 511, 427 and 34 of the Indian Penal Code.
3. As per the prosecution case, there is a plot in the name of informant's sister near Domuhan and there is allegation against the co-accused Munna Paswan and the petitioner that they broke the gate of the said plot and carried the bricks on the tractor.
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner is a labour and he was not involved in the occurrence as alleged. Learned counsel
Patna High Court CR. MISC. No.25948 of 2024(3) dt.31-07-2024 2/2 submits that the charge-sheet has already been submitted before the Court Concerned and the cognizance has been taken against the petitioner. He further submits that petitioner has no criminal antecedent and he undertakes to co-operate in the investigation and the trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Gaya / Concerned Trial Court in connection with Bodhgaya P.S. Case No. 315 of 2020, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
