====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and learned A.C. to G.P. 19 for the State.

The present application seeks quashing of F.I.R. of Ara Nawadah P.S. Case No. 464 of 2014 dated 12.09.2014 as far as it relates to the petitioner.

As per the allegation a mob of students had vandalized the police jeep and various other properties and the reason behind it was that the petitioner, being the proprietor of a coaching institute had instigated them in retaliation to the raid by the Income Tax Department at his premises.

Learned counsel for the petitioner submits that

Patna High Court Cr. WJC No.1165 of 2014 (2) dt.21-07-2015 2/2 nothing incriminating has come during investigation to indicate that it was the petitioner who was behind such incident. Counter affidavit has been filed on behalf of Respondent No. 5 in which it has been stated that after investigation chargesheet has been submitted against the accused including the petitioner.

In view of the aforesaid, learned counsel for the petitioner seeks permission to withdraw the application with liberty to raise his grievances in accordance with law at the appropriate stage.

Accordingly, the application stands disposed off as withdrawn with the liberty aforesaid.
