JUSTICE PARTHA SARTHY ORAL ORDER 06-04-2022 It is submitted by learned counsel for the petitioner that vide order dated 16.4.2020 passed in the instant application in view of the defects having been pointed out by the office, provisional bail was granted to the petitioner in connection with Gardanibagh P.S. Case no.78 of 2020 with the further direction to remove the defects.

It is submitted that as the full physical functioning of the Court as well as the offices have not commenced in this Court as also in the learned Court below, for this reason alone the defects could not be removed.

Having heard learned counsel for the parties, the provisional bail granted to the petitioner vide order dated 16.4.2020 in connection with Gardanibagh P.S. Case non 78 of 2020 (Special Case no.1403 of 20200) pending in the Court of

Patna High Court CR. MISC. No.19082 of 2020(5) dt.06-04-2022 2/2 learned Special Judge, Excise, Patna is hereby confirmed. It is directed that soon after the normal functioning of the Court is restored the petitioner shall remove the defects pointed out by the office within a period of four weeks.
