The petitioner is languishing in jail since 27.06.2016 in a case registered for offences punishable under Sections 376, 511 and 34 of Indian Penal Code.

The allegation against the petitioner is of attempting to commit rape with the informant.

From the order of the 1st Additional District and Sessions Judge, Jamui it appears, F.I.R. has been lodged in the year, 2001 and petitioner remained absconder. Due to non appearance of petitioner the trial has been delayed for about 15 years. The charge sheet has been filed showing the petitioner as absconder.

Patna High Court Cr.Misc. No.43 of 2017 (4) dt.03-04-2017 2/2 The Court below in the status report has stated that this petitioner was declared absconder on 28.06.2011. The charge has been framed on 04.03.2017. The case is fixed for evidence on 27.03.2017 Having regard to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner, Prayer is, accordingly, rejected.

The Trial Court is directed to expedite the trial and conclude it expeditiously without granting unnecessary adjournment to any party.
