Mr. Jitendra Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 19-03-2025 Heard the learned counsel for the petitioners as well as the learned APP for the State.

2. The petitioners apprehend their arrest in connection with Wazirganj P.S. Case No. 361 of 2020 registered for offences under Sections 147, 148, 149, 323, 307, 302, 504, 506 and 324 of the Indian Penal Code.

3. As per the prosecution case, the petitioners along with others are alleged to have assaulted the victim causing his death.

4. The learned counsel for the petitioners has submitted that the petitioners are innocent and there is general and omnibus allegation against them and therefore they deserve anticipatory bail.

5. Learned APP for the State has vehemently opposed

Patna High Court CR. MISC. No.36698 of 2024(5) dt.19-03-2025 2/2 the prayer for anticipatory bail and has submitted that the petitioners are absconders. He further submits that the petitioners along with others are the assailants of the deceased as well as the injured persons.

6. Considering the fact that the petitioners have assaulted the deceased along with others and in the post mortem report a number of injuries have come, I am not inclined to grant anticipatory bail to the petitioners.

7. The application for anticipatory bail is, accordingly, dismissed.

8. The petitioners are directed to surrender in the court below within a period of four weeks from today and seek regular bail, if so advised.

9. If the petitioners do not surrender within four weeks then the Senior Superintendent of Police, Gaya will take all steps for arresting the petitioners.

10. Let a copy of this order be communicated to the Senior Superintendent of Police, Gaya through FAX for its compliance forthwith (Sandeep Kumar, J) Shishir/- U T
