JUSTICE ASHUTOSH KUMAR) Date : 21-07-2022 Heard Mr. Birendra Kumar Singh, learned Advocate for the petitioner and Mr. Upendra Pratap Singh, learned AC to SC -4. The petitioner is the son of a PDS licensee, who died during the tenure of his license. The petitioner had made an application for being granted license on compassionate ground for which necessary documentation was made available by the petitioner before the concerned authority, but till date, no decision appears to have been taken in that regard.

Patna High Court CWJC No.5875 of 2022 dt.21-07-2022 2/2 The learned counsel for the petitioner has submitted that the petitioner is entitled to be granted or at least being considered for grant of license under Clause - 10 of the Bihar Targeted P.D.S. (Control) Order, 2016.

There is no reason why no decision has been taken on such application as yet.

Under the aforesaid facts and circumstances of the case, we direct the concerned authority to advert to the application preferred by the petitioner for grant of license on compassionate ground and if at all it is found that he deserves to be given one, necessary sequel order shall also be passed. The aforesaid exercise be concluded within a period of ninety days from the date of receipt/production of a copy of this order before the appropriate authority.

The writ petition stands disposed of with the aforesaid direction.
