On the death of the father of the petitioner, who was a licencee under the Public Distribution System, the petitioner had applied for licence on compassionate ground but such application has remained pending before the authorities for the last 2 years.

Patna High Court CWJC No.5877 of 2022 dt.27-07-2022 2/3 The learned counsel for the petitioner has rightly submitted that such delay in disposal of the aforesaid application is inexplicable.

We do not find any reason for the authorities to keep such petition pending. A decision is required to be taken by the authorities whether the petitioner is entitled for such concession, namely, the grant of licence on compassionate ground. Any delay in the matter unnecessarily raises grievance against the working of the system.

Under the aforesaid circumstances, we direct the concerned authority to dispose of the application of the petitioner without any further delay.

In case, it is found that the petitioner deserves to be granted licence on compassionate ground, necessary sequel or order shall be passed. If not, that shall also be communicated to the petitioner with reasons.

It is excepted that the authority in question shall do the needful within 90 days of the receipt/production of a copy of this order.
