JUSTICE SANJAY PRIYA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Goraul (Kathara O.P.) P.S. Case No. 290 of 2016 instituted for the offence under sections 341, 323, 325, 307/34 of the Indian Penal Code.

It has been submitted that informant is Bhabhi of the petitioner and occurrence took place on account of land dispute. There is allegation againt this petitioner that he assaulted the husband of the informant with lathi, causing injury in his both hands and he got treated in Primary Health Center, Vaishali. The learned Sessions Judge has mentioned in the impugned order that doctor has found swelling on both the arms and the opinion has been kept reserved and injured was advised

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Goraul (Kathara O.P.) P.S. Case No. 290 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Vaishali at Hajipur. subject to the conditions as laid down under Section 438(2) Cr.P.C.
