Heard Mr. Alok Kumar Alok, learned Counsel for the petitioner and Mr. Binod Kumar, learned Additional Public Prosecutor appearing for the State.

The present application has been filed for modification of the order, dated 13.02.2020, passed in Criminal Misc. No. 74478 of 2019, whereby the petitioner has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court (Prabhat Kumar Singh, J.), to the extent that the period of surrender may be extended further.

Learned Counsel for the petitioner submits that in

Patna High Court CR. MISC. No.19086 of 2020(2) dt.21-04-2020 2/3 view of the prevailing nationwide lockdown due to outbreak of COVID 19 pandemic in the country, the petitioner could not surrender before the learned Court below to furnish bail bonds in terms of order, dated 13.02.2020, passed in Criminal Misc. No. 74478 of 2019, and within the time granted by the Court. Learned Additional Public Prosecutor appearing for the State has no objection if the prayer of the petitioner for extension of time to surrender before the learned Court below is allowed.

After hearing learned Counsel for the parties and taking into consideration the statement made in the modification application, I am inclined to modify the order, dated 13.02.2020, passed in Criminal Misc. No.74478 of 2019, to the extent that the time granted by this Court for surrender of the petitioner before the learned Court below to furnish bail bonds be extended by further three weeks from the date of lifting of the Lockdown in the State of Bihar.

Accordingly, this modification application is allowed to the extent indicated above.

Learned Counsel for the petitioner is further directed to remove the defects, as pointed out by the Stamp Reporter, within a period of three weeks from the date of lifting of the
