1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 504, 506/ 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The learned counsel for the petitioners submits that the petitioner no.1 has antecedent of four cases, but was

No.28965 of 2023(2) dt.23-08-2023 2/3 acquitted in three cases and is on bail in the last case, petitioner nos.2 and 4 have antecedent of two cases and petitioner no.3 has antecedent of one case and petitioner nos.5 and 6 are persons with clean antecedent and the informant alleges that the accused persons crossed him variously armed while he was sitting with Julmi Singh near fire at 8.00 A.M. on 08.01.2023. Accordingly, he asked the accused persons as to where they were going, on which they asked about Indal Singh and also said that they would kill Indal Singh, on which he tried to instill sense in them, on which Ranjeet Singh fired causing injury on his toe.
4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case. It is next submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that the specific allegation of firing is against Ranjeet Singh causing injury on toe of the informant.
5. Learned A.P.P. opposes the bail application.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like
Patna High Court CR. MISC. No.28965 of 2023(2) dt.23-08-2023 3/3 amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Muffasil P. S. Case No.09 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
