JUSTICE SANJAY PRIYA ORAL ORDER 30-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Simra P.S. Case No. 5 of 2016 instituted for the offence under Section 409 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. He has been made accused subsequently as Ghanshyam Ram, Panchayat Secretary named in the written report, has taken charge from him in the year 2010. The charge report has been enclosed as Annexure-2 from which it appears that petitioner had not received the records/documents/papers with regard to the appointment of teacher for the years 2003, 2005, 2006 and 2008. Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.65609 of 2018 (2) dt.30-10-2018 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Simra P.S. Case No. 5 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
