JUSTICE PARTHA SARTHY Oral Order 11.9.2020 Heard learned counsel for the petitioner and learned GP 4 for the State through video conferencing. The petitioner has filed the instant writ application praying for setting aside the order of transfer of the petitioner dated 25.3.2020 (Annexure - 2) issued by the Urban Development and Housing Department, Government of Bihar whereby the petitioner, an Executive Engineer, was transferred from Patna Municipal Corporation to Samastipur Municipal region.

A further prayer has been made for directing the respondents to consider the representation filed by the petitioner and for other reliefs. Bereft of unnecessary details it may be stated here that a supplementary counter affidavit has been filed on behalf of the respondent no. 1. Referring to paragraph no.

9 of the said counter affidavit it is submitted by learned G.P 4 that keeping in view the date of retirement of the petitioner which is 30.9.2020 the department considered the representation of the petitioner and the petitioner has been transferred from Samastipur to the office of the Engineering Chief-cum-Special Secretary (Flying Squad) at headquarter, Patna as per his choice, by order dated 30.6.2020 (Annexure-C to the supplementary counter affidavit).

In view of the above order of transfer dated 30.9.2020, it is submitted by learned counsel for the petitioner that he does not want to pursue the writ application any further as the relief prayed for has been granted.

Accordingly, the instant writ application stands disposed.
