2. In the present case, the petitioner seeks bail in connection with Shahpur P.S. Case No. 485/2025, registered for the offences under Sections 126(2), 115(2), 118, 109 and 3(5) of BNS.
3. As per the prosecution case, the petitioner and coaccused Abhimanu Kumar @ Mannu had been hurling abuses under intoxicated condition. When the father of the informant went to pacify them, they started abusing the father of the informant. Thereafter, their neighbours, namely Golu and Tinku also came there and the co-accused Mannu stabbed the father of the informant in his stomach resulting in excessive blooding. 4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. There is no specific allegation of assault against the petitioner as the allegation is specific against co-accused Mannu. Only allegation against the petitioner is that of hurling abuses. The co-accused Abhimanu Kumar @ Mannu has been granted bail by the learned Coordinate Bench of this Court vide order dated 24.06.2026 passed in Cr. Misc. No.29898 of 2026. The petitioner is in custody since 27.12.2025 and is having clean antecedents. The charge sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that there is no allegation of assault against the petitioner and further considering the period of custody of the petitioner and his clean antecedent as well as submission of charge sheet against him, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate,
Patna High Court CR. MISC. No.22446 of 2026(4) dt.15-07-2026 3/3 Danapur, Patna/court concerned, in connection with Shahpur P.S. Case No. 485 of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
