JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with N.D.P.S. Case No. 84 of 2013 arising out of Raxaul P.S. Case No. 132 of 2013 registered under Sections 20, 22, 23 and 24 of the Narcotics Drugs and Psychotropic Substance (NDPS) Act, pending in the court of Ist Additional Sessions Judge, Motihari, East Champaran. The accusation is that some persons were seen in suspicious condition carrying the packets at their head, on which, informant and other personnel of S.S.B. tried to chase them. In that course, the petitioner was apprehended while others succeeded to flee away throwing the packets from their head. The informant collected the seven packets from there, which was

Learned counsel for the petitioner submits petitioner has falsely been implicated in this case mere on suspicion. Further submission is that petitioner has no criminal antecedent and is in custody since 19.05.2015.

Having considered the facts and circumstances of the case, the nature of allegation against the petitioner and also quantity of seized Ganja, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
