The Petitioner apprehends his arrest in Ariyari P.S. Case No. 130 of 2015 registered for the offence punishable under Sections 147, 148, 149 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case as there is land dispute. The petitioner is student and nothing has been recovered from his possession. One of the co-accused Rambilas Yadav has been granted bail by a co-ordinate bench of this Court vide order dated 18.10.2016 passed in Criminal Miscellaneous No. 43460 of 2016. Considering the aforesaid facts and circumstances of the case, let the petitioner named above in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sheikhpura in connection with Ariyari P.S. Case No. 130 of 2015; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
