JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2018 Petitioner prays for bail in connection with Daraunda P.S.Case No. 127 of 2018 registered for the offences punishable under Sections 379, 411 and 414 of the Indian Penal Code. Allegation against the accused persons, including the petitioner is of committing theft of motorcycle of the informant and they were arrested on chase and motorcycle was recovered. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has no criminal antecedent and co-accused persons have been granted bail by a co-ordinate Bench of this Court vide order dated 4.10.2018 passed in Cr.Misc.No.54044 of 2018 and petitioner is in custody since 2.7.2018.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.65228 of 2018(2) dt.06-11-2018 2/2 circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Siwan, in connection with Daraunda P.S.Case No. 127 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
